Verisign will have to pay for sex.com mistake

Gary "sex.com" Kremen has won an important victory in his legal battle to get justice for the theft of his lucrative domain, which the bumbling fools of Network Solutions gave away to a con-man who forged a fax to them. Since Kremen's contract with NSI predated the addition of the "you indeminfy us from all liability no matter how negiligent we are" language to its agreement (and the even crappier terms of service imposed by Verisign when it acquired the company) the court has ruled that Verisign is liable for NSI's mistake.

"Exposing Network Solutions to liability when it gives away a registrant's domain name on the basis of a forged letter is no different from holding a corporation liable when it gives away someone's shares under the same circumstances," wrote Judge Alex Kozinski, who penned the unanimous opinion for the three-judge panel.
