Prosecutors want to photograph erect penis of teen accused of sexting girlfriend

In Manassas City, Virginia, a teen boy who is accused of sending a sexually explicit video to his teen girlfriend by cellphone may be forced by prosecutors to go to a hospital and get an erection injection, then allow police to photograph him with his penis in an erect state.

The teen was charged with possession of child pornography and manufacturing child pornography in January, after exchanging texts with his 15-year-old girlfriend. Police took his iPhone and iPad .

Jessica Harbeson Foster, a defense attorney for the teen, says a detective told her that after photos of the teen’s erect penis were taken the detective would “use special software to compare pictures of this penis to this penis."

"Who does this?," Foster said. "It’s just crazy.”

“The prosecutor’s job is to seek justice,” said the teen’s defense lawyer, Jessica Harbeson Foster. “What is just about this? How does this advance the interest of the Commonwealth? This is a 17-year-old who goes to school every day, plays football, has never been in trouble with the law before. Now he’s saddled with two felonies and the implication that he’s a sexual predator. I don’t mind trying the case. My goal is to stop the search warrant. I don’t want him to go through that. Taking him down to the hospital so he can get an erection in front of all those cops, that’s traumatizing.”

  1. IMB says:

Since he's only 17, shouldn't the prosecutors be charged for seeking child porn? They are requesting shots of the kid's penis.

  2. Man - that kid is lucky. I usually have to pay through the nose to get a bunch of guys dressed as cops to stand around me watching me masturbate.

  3. How is this not going to mess him up for a long, long time? How is he not going to associate getting an erection or even just getting sexual, the natural and normal thing, with having his life demolished? Once again, the process is the punishment, and in this case it's cruel and unusual. Unreal.

  4. So the prosecution, in the name of enforcing a law meant to protect a child from sexual abuse, victimizes said child by subjecting him to sexual abuse, so that it can convict him as a sexual predator.

Perverse in every sense of the word.

  5. So the name Paul Ebert rang a bell. Yes it is This Paul Ebert. The commonwealth attorney so awful that it inspired This campaign to replace him.
