A California appeals court has hit play on the state's most malodorous earworm.
A lower court ruled last month that Kars4Kids' ads violated California false-advertising and unfair-competition laws by failing to clearly disclose where the donated-car money primarily goes. The judge ordered the ads off California airwaves unless they added clearer disclosures. Kars4Kids appealed, and now the jingle gets to keep haunting Californians while the case continues.
An appeals court in California ruled on Thursday that Kars4Kids, the charity known for its ear-worm jingle, can continue broadcasting in California for now.
The decision, issued by the California Court of Appeal, Fourth Appellate District, which hears appellate cases from the Orange County Superior Court, is the latest step in a legal case against the organization that claims its advertisements are misleading.
